BU’s Sascha Dov Bachmann visits Qatar Armed Forces

Dr Sascha Dov Bachmann, Associate Professor in International Law and Extraordinary Associate Professor in War Studies (Swedish Defence University) visits the Qatar Armed Forces to speak about his work on Hybrid Warfare and the use of law in defensive and offensive operations.

He was invited by the prestigious Joaan Bin Jassim Command and Staff College which has close ties to King’s College London to discuss emerging threat issues in the Gulf region and potential countermeasures.

Sascha will highlight the role of law fare as a potential counter measure and built on his work undertaken on the subject jointly with colleagues from NATO, the Swedish Defence College and the UK Army.

Dr Sascha-Dominik Bachmann, Associate Professor in International Law (Bournemouth University, UK) and extraordinary Associate Professor in War Studies (Swedish Defence University, SWE) jointly with Andres Mosquera, Director Legal Advisor to NATO’s Commander of the Supreme Headquarters Allied Powers Europe (SHAPE) had their written evidence accepted for publication by the UK Parliament’s Defence Sub-Committee.

The submission titled Russian Law fare Capabilities As A Threat To The Arctic discusses the use of lawfare (abuse of the rule of law) to achieve strategic objectives. It can be viewed at the Defence Committee’s website and here.

Going for Gold: 3D Printing, Jewellery and the Future of Intellectual Property Law

About the Event:

Additive Manufacturing or 3D printing as it is more commonly known, continues to push the boundaries of Intellectual Property (IP) law whilst raising questions relating to the protection and exploitation of IP.

There have been various attempts to address these questions through legal and empirical studies; yet at the same time, there continues to be limited literature and debate on the implications of 3D printing surrounding IP law, industry, society, technology and policy.

This challenge, which extends to the lucrative jewellery sector raises further questions in relation to creativity, design, copyright and licensing and these issues will be addressed at the event by bringing together experts from the cultural and business sectors including designers, manufacturers, distributors, policy makers and legal professionals.

This multi-disciplinary event which will explore the above issues will also provide the platform for a discussion of the ‘Going for Gold’ project carried out by researchers at CIPPM (Bournemouth University) in collaboration with Museotechniki Ltd and Uformia AS and will be complemented by a demonstration of 3D printed jewellery artefacts resulting from the project.

The event, based on the ‘Going for Gold’ project led by Professor Dinusha Mendis, is supported by the RCUK funded Centre for Copyright and New Business Models in the Creative Economy (CREATe), AHRC Grant Number AH/K000179/1 and builds on the BU/CIPPM-led UK Intellectual Property Office (UKIPO) Commissioned Study on 3D Printing and IP law completed in 2015.

Call for Papers for the 15^th Nepal Study Days

12-13 April 2017 hosted by Bournemouth University, UK

The Britain Nepal Academic Council (BNAC) invites scholars and practitioners from all disciplines to participate in the 15^th BNAC Nepal Study Days. All presentations should focus on Nepal, its diaspora and/or the Nepali cultural world. We invite presentations that share research findings, preferably of work that has reached an advanced stage or has been completed. The 2017 event will be held in Bournemouth House at Bournemouth University. Details of previous study days can be accessed online here! We also invite proposals for research posters.

If you are interested in participating, please send a 300-word abstract of your proposed presentation to bnacstudyday@gmail.com by 28^th February 2017. The Study Days organizing committee will review the proposals received on time and make a selection. Selected abstracts will be circulated to registered participants in advance and posted to the BNAC website.

Members of BNAC may attend the Nepal Study Days for free, though we will ask for a contribution towards the costs of the lunches. For non-members there will be a registration fee of £25, which will include lunch on both days.

Fusion project leads to best paper award

Work by BU researchers examining the human aspects of Digital Rights Management has won a best paper award at the Fourth International Workshop on Artificial Intelligence and IP Law. This is joint work carried out by Marcella Favale, Neil McDonald, Shamal Faily, and Christos Gatzidis.

This work, which resulted from research carried out during the FIF funded MADRIGAL project, examines the perspective of DRM from the perspective of content creators using qualitative socio-legal analysis.

In addition to this work, we were also invited to write an extended version of this paper for SCRIPTed, which is currently in press.

Dr. Dinusha Mendis to deliver a keynote speech based on her research at 3D Printing and IP Conference, London

CIPPM Co-Director, Dr. Dinusha Mendis, will deliver a keynote speech today at a conference organised by Anti-Copying in Design (ACID) and Alliance for Intellectual Property titled ‘3D Printing: Identifying the Opportunities and Exploring the IP Challenges’.

The Conference highlights the technology of 3D printing, the opportunities it brings about and the potential gaps that key stakeholders should be aware in the context of Intellectual Property (IP) Law. The event will include, presentations and panel discussions with the audience, which will be led by industry leaders and IP specialists in the creative industries.

Dr. Mendis will present her keynote speech on the ‘Legal and Empirical Study into the IP Implications of 3D Printing’. The keynote will be based on her completed commissioned project for the UK Intellectual Property Office (UKIPO) in 2015 and her on-going AHRC funded project titled ‘Going for Gold’ exploring the copyright, contractual and licensing implications arising from 3D scanning, 3D printing and mass customisation of ancient and modern jewellery.

Anti-Copying in Design (ACID) is a membership trade organisation, set up as a round table action group in 1996, by designers for designers. ACID is committed to raising awareness and encouraging respect for IP and in helping its members to understand and protect their rights, ACID is intent on stamping out intellectual property rights abuse.

Alliance for IP represents trade associations across the creative, branded and design industries concerned with ensuring that IP rights are valued in the UK. Its members include representatives of the audiovisual, music, games and business software, and sports industries, branded manufactured goods, publishers, retailers and designers

BU Academic Delivers Invited Talk at a United Nations Organised Event in Turin, Italy

Dr. Dinusha Mendis, Co-Director of the Centre for Intellectual Property Policy and Management (CIPPM) was invited to deliver a talk on her research into Intellectual Property and Emerging Technologies, with a focus on 3D printing at an event organised by the UN Agency, World Intellectual Property Organisation (WIPO) and University of Turin, Law School, Italy. The talk was delivered on 24th October 2016.

The event which formed part of the Master of Laws Programme, offered jointly with the World Intellectual Property Organisation (WIPO) Academy and University of Turin, was hosted in collaboration with the International Training Centre of the International Labour Organisation (ITCILO) with financial support from the Government of Italy and was attended by academics, practitioners and officials from WIPO and ITCILO.

Dr. Mendis spoke about the legal status surrounding 3D printing, with a particular focus on the funded research carried out for the UK Intellectual Property Office ( completed 2015) and the current AHRC funded project titled ‘Going for Gold’ exploring the intellectual property implications surrounding 3D scanning, 3D printing and mass customisation from the point of view of cultural and business sectors.

Other speakers at the event included, Ms. Martha Chikowore (WIPO Academy, Training Officer), Mr. Ralf Kruger (Manager, Turin School of Development), Professor Alessandro Cogo (University of Turin), Professor Marco Ricolfi (University of Turin), Mr. Paolo Marzano (LUISS, University, Rome) and Dr. Thomas Margoni (CREATe, University of Glasgow).

1st International Military Law Conference in South Africa – BU Research receives global attention

Associate Professor in International Law (BU) and War Studies (FHS) Sascha Dov Bachmann just returned from Johannesburg where he presented on Hybrid War and Lawfare at the 1^st International Military Law Conference in South Africa. A great experience and and from a media point of view as well as from a BU research point of view the conference and its coverage in the regional African and international media were a full success.

The objectives of the conference – to raise public awareness of the importance of military law in a democracy and to stimulate interest in academic research in this specialised field of public law to strengthen the development of South African military law – were successfully met with a number of international and local academics and military professionals presenting research papers, according to the South African National Defence Force (SANDF).

The conference was officially opened by SA National Defence Force Chief, General Solly Shoke. In his opening address he welcomed the opportunity provided by the conference for South African military lawyers to benchmark local approaches with that of other armed forces. He also expressed the wish for the conference to provide a basis for evaluating whether any amendments to military and other legislation may be necessary to empower commanders to instil and maintain military discipline.

BU’s Dr.Sascha Dov Bachmann to speak at conference convened by the South African National Defence Force (SANDF)

Dr Sascha Dov Bachmann, Associate Professor in International Law and Extraordinary Associate Professor in War Studies (Swedish Defence University) will present his work on Hybrid War and law fare in the 21st Century at SANDF’s First International Conference on Military Law, in Pretoria from 1 to 3 November.

The objective of the conference is to expose and bring awareness to the South African public in general and academia in particular on the importance of Military Law within a country’s legal system.

South Africa is among the leading countries in contributing military personnel and major equipment for peace missions in pursuance of its policy to promote peace and stability in the continent. The country’s important role in mediation to end conflicts, has earned it a good standing, reputation and respect among the community of nations.

As an active participant in international structures, South Africa raises the interests of the African continent and other developing countries. Since it plays a meaningful role for the success of the region and the continent, it is incumbent that it stays afloat in every spectrum possible including the development and application of Military Law.

Furthermore here at home, the community at large; to some extent the Military community; academia and jurors alike seem not to be aware of the relevance, extent and application of Military Law.

The Conference will be opened by the Minister of Defence and Military Veterans the Honourable Minister N.N. Mapisa-Nqakula. The Key Note Speaker will be our former Chief Justice, Justice Sandile Ngcobo.

Dr Sascha Dov Bachmann will present the findings on an ongoing project on Hybrid War and lawfare and how it impacts on AU states and their operational capacities and abilities.

The social sciences at BU

Earlier this year a Fusion-funded series of public events at BU was organised by Professors Ann Brooks (FHSS), Candida Yates (FMC) and Barry Richards (FMC). For these ‘Dialogues in the Social Sciences’, leading social scientists were invited to speak at BU, along with other figures from outside and inside academia, on topics of current concern. The aim was to offer to BU students and staff, and to members of the local public, opportunities to hear and take part in authoritative and informed discussion of social and political issues.

The first was entitled ‘Increasing inequality? Widening opportunity? Debating higher education reform’ Two leading educationists from the University of London Institute of Education discussed the Higher Education Green Paper. Professor Sir Peter Scott (former editor of THE, and former V-C of Kingston University) and Professor Ann Phoenix, eminent psychosocial researcher, outlined their analysis of the prospects for the sector. BU’s Dr. Mastoureh Fathi (FHSS) and Ellie Mayo-Ward (SUBU V-P) were respondents. Chaired by Professor Iain MacRury of FMC, this event explored some of the risks to the sector in the current proposals.

In the second event (‘Our scandalised society’), criminologist Professor Chris Greer (City University) and Lord Blair (Sir Ian Blair, former Commissioner of the Met) discussed key issues regarding how the British state is responding to scandal proliferation, the implications of scandal for crime control and institutional regulation in the digital age, and the risk of scapegoating as a substitute for understanding and solving, particularly in a 24/7 news environment. Professor Ann Brooks was in the chair for an intriguing examination of the roles of both media and police in this complex intersection of social changes.

Professor Matthew Feldman of Teesside University is an expert on the Far Right; he was joined for the third and final event by Emman el-Badawy of the University of Exeter and the Centre on Religion and Geopolitics, and Dr Usama Hasan of the counter-radicalisation organisation the Quilliam Foundation, both experts on violent jihadism. Under the title of ‘Radicalisation: what is it and what threat does it pose?’, Professor Barry Richards chaired a wide-ranging discussion which both put the current threat of Islamist terror in broader historical contexts and looked closely at some of the debates around the Prevent counter-terrorism programme.

Each one of these events demonstrated that with excellent speakers and a thoughtful audience, a good discussion is guaranteed. All of them involved both students and members of the public, though the challenge of drawing in large numbers for early evening extra-curricular events was also in evidence. As well as their value to participants, these events flagged up internally and externally that BU has a growing base of social-scientific expertise, networked with internationally leading experts and pursuing a clear public engagement mission.

CIPPM’s AHRC-funded Project Copyrightuser.org publishes Episode II of the Award-Winning ‘Game is On!’ Film

Copyrightuser.org – is a collaboration between the Law Department’s Centre for Intellectual Property Policy and Management (CIPPM) at Bournemouth University (BU) and CREATe, University of Glasgow, has produced Episode II of the ‘Game is On!’ Series.

The project led by the Principal Investigator for Bournemouth University, Dr. Dinusha Mendis, Associate Professor in Law and Co-Director of CIPPM was initially funded by BU’s Fusion Investment Fund in 2012. Since 2013 the project has been successful in securing AHRC funding under the leadership of Dr. Mendis and in November 2015, won the AHRC Innovation in Film Award.

Game is On! by Copyrightuser.org is a s a series of short animated films that puts copyright and creativity under the magnifying glass of Sherlock Holmes, providing a unique, research-led and open access resource for school-aged learners and other creative users of copyright. Drawing inspiration from well-known copyright and public domain work, as well as recent copyright litigation, these films provide a springboard for exploring key principles and ideas underpinning copyright law, creativity, and the limits of lawful appropriation and reuse.

Episode I of the ‘Game is On!’ Series titled The Adventure of the Girl with the Light Blue Hair won the AHRC Innovation in Film Award in November 2015 and was shortlisted for a BUFVC Learning on Screen Award in April 2016 and has been recently used by Into Film to develop the educational resource ‘Exploring copyright for clubs’.

The accompanying Case Files – an important feature of the ‘Game is On!’ series – for Episode I was authored by CIPPM’s Co-Director, Dr. Dinusha Mendis and CIPPM PhD Candidate, Ms. Hayleigh Bosher.

Episode II titled The Adventure of the Six Detectives is also accompanied by a number of Case Files, authored by CREATe researchers Megan Rae Blakely and Andrea Wallace and offer points of discussion around many of the most pressing copyright questions and concerns faced by screenwriters: http://copyrightuser.org/the-game-is-on/episode-2/

BU Academic Presents AHRC Funded 3D Printing Research Through a Treasure Hunt Theme

Dr. Dinusha Mendis, Associate Professor in Law and Co-Director of the Centre for Intellectual Property Policy and Management (CIPPM) presented a poster at the 107th Society of Legal Scholars Conference 2016 capturing the research carried out for the Going for Gold Project.

The AHRC-funded ‘Going for Gold’ project explores the intellectual property implications of 3D scanning, 3D printing and mass customisation of ancient and modern jewellery, with a particular focus on the cultural and business sectors. In so doing, the project considers the copyright, design, licensing and contractual issues faced by key stakeholders in these industries.

The poster (illustration below) showcases the research carried out in the cultural sector (ancient jewellery), in collaboration with museums and points out the challenges faced by the museums as well as the opportunities which lie ahead in embracing this technology.

The research is led by Dr. Mendis in collaboration with Museotechniki Ltd and Uformia Ltd and the research team will produce Practice Guidelines on the adoption of 3D scanning, 3D printing and mass customisation within the cultural and business sectors.

This project builds on the research carried out for the UK Intellectual Property Office Commissioned Project on the IP implications of 3D Printing which was completed in 2015, leading to the publication of three reports.

Congratulations to BU Visiting Faculty Dr. Sam Rowlands

Dr. Sam Rowlands, FHSS Visiting Faculty, has just published an interesting article on ‘On being an expert witness in sexual and reproductive health’. The paper will appear in the Journal of Family Planning & Reproductive Health Care [1]. In this article Sam highlights that expert witnesses need to be able to apply appropriate legal tests to the evidence, to deal with the range of expert opinion on a matter, and explain clearly what constitutes an appropriate standard of care for a clinician in their discipline and specialty. They must be aware of pitfalls such as being sued for substandard work and being reported to their professional regulator for straying outside their area of expertise. Expert witnesses must be truly independent and ideally their reports should be the same whoever they receive their instructions from.

Going for Gold! 3D Scanning, 3D Printing and Mass Customisation of Ancient and Modern Jewellery – Dr. Dinusha Mendis delivers invited talks in Southampton, Newcastle and London

In July 2016, Dr. Dinusha Mendis Associate Professor in Law and Co-Director of the Centre for Intellectual Property Policy and Management (CIPPM) disseminated her research on the Intellectual Property (IP) implications of 3D scanning, 3D printing and mass customisation in Southampton, Newcastle and London.

Questioning what the future holds for IP law as a result of technologies such as 3D printing, Dr. Mendis spoke about the research she has conducted for the UK Government (UK Intellectual Property Office) as well as the research she is conducting for her RCUK/AHRC-funded project ‘Going for Gold’ considering the IP implications of 3D scanning, 3D printing and mass customisation of ancient and modern jewellery.

Cross-Hub Workshop on 3D Printing, Southampton Solent University, 5th July 2016

The event titled ‘Cross-Hub Workshop: 3D Printing: Development, Application and its Contribution to Local Economy’ hosted speakers from industry, academia and professional practice thereby presenting the opportunity to explore and discuss the digital opportunities and its potential contribution to local/national economy in the development and application of 3D printing technology.

Dr. Mendis was invited to speak about her research into the intellectual property implications of 3D printing and presented the results from the commissioned research carried out for the UK Intellectual Property Office, which led to the publication of 2 Reports and an Executive Summary in 2015, whilst outlining the copyright, design and licensing implications relating to cultural institutions and SMEs in 3D scanning and printing ancient and modern jewellery.

At this 2-day event, Dr. Mendis was invited to speak about law’s response to innovation and emerging technologies. Dr. Mendis’ presentation explored law’s resilience to dynamic change, in particular, and questioned whether legislators should adapt to innovation whilst adopting innovative regulation. The 2 day event began with a keynote speech by Professor Dan Faber of UC Berkeley and concluded with a keynote speech by Professor Karen Yeung of Kings College London.

The event marked the launch of Dr. Angela Daly’s new book on 3D Printing and commenced with a presentation from Dr. Daly, a research fellow at Queensland University of Technology Faculty of Law, Australia. Dr. Daly’s presentation was followed by an invited guest lecture from Dr. Mendis who spoke about the IP implications of 3D printing, highlighting the challenges and opportunities which this technology has brought about, whilst outlining the next steps for 3D printing, from a legal perspective. Dr. Dinusha Mendis invited to present her research at the House of Lords and at a leading London Law Firm

House of Lords1 In the last few months, Dr. Dinusha Mendis, Associate Professor in Law and Co-Director of the Centre for Intellectual Property Policy and Management (CIPPM) was invited to speak at the House of Lords and deliver a keynote speech at a leading London Law Firm, Herbert Smith Freehills. The invited talks involved disseminating her recent research into the intellectual property (IP) implications of 3D printing.

Earlier this year, Dr. Mendis was invited by Herbert Smith Freehills LLP, to deliver a keynote speech at their annual Intellectual Property Update Conference . The event attended by over a 100 delegates, included companies such as BBC, BT, Lloyds Banking Group, Barclays, Jaguar Land Rover, Sky Plc, Sony, PLC Thomson Reuters, Oxford University Press, Walt Disney, Warner Bros Entertainment, Wellcome Trust and Unilever to name a few.

Dr. Mendis delivered the keynote speech on ‘The Challenges and Opportunities Presented by 3D Printing’. In delivering the keynote, Dr. Mendis spoke about the research carried out for the UK Intellectual Property Office Commissioned project, which was completed in 2015, whilst also giving an insight into the research being carried out at present.

The IP Update Conference was chaired by Mark Shillito (Partner, Head of Disputes, UK and US; and Global Head of Intellectual Property).

The event was organised by Mr. Julian Hobbins, Deputy Chairman of the Federation Against Software Theft (FAST) and hosted by Lord Tim Clement-Jones (Spokesperson for Creative Industries) of the House of Lords.

Dr. Mendis’s presentation titled ‘3D Printing, Copyright and Software: What is the Mischief’? explored the intellectual property implications surrounding Computer-Aided Design (CAD) files needed for 3D printing and the legal position from a UK and European perspective.

Other speakers on the day included Mr. Richard Bach, Assistant Director of the Cyber Security Digital Economy Unit DCMS and Mr. Richard Pharro, CEO at APMG – Cyber Essentials.
